Defendant

A and C shall be punished by imprisonment for eight months, and by imprisonment for one year, respectively.

However, from the date this judgment becomes final and conclusive, each.

Punishment of the crime

If a foreigner intends to continue to sojourn in excess of the period of sojourn, he/she shall obtain permission for extension of the period of sojourn from the Minister of Justice before the period of sojourn expires, as prescribed by Presidential Decree,

1. Defendant A

A. On August 18, 2018, the Defendant violated the Immigration Control Act, entering the Republic of Korea as a visa exemption (B-1) and continued to stay in the Republic of Korea beyond the period of sojourn without obtaining permission for extension of the period of sojourn, despite the expiration of the period of sojourn on November 11, 2018.

B. On December 25, 2020, the Defendant: (a) Handphone medication around December 25, 2020, around the same day from around 21:00 to 22:00 on December 25, 2020; (b) putting in the Defendant’s home on the Defendant’s home on the 1st floor the non-fluorculic cam (i.e., one philophone; hereinafter “copon”); (c) inserting the smoke caused by heating the copon into a plastic bag; and (d) administering it in the copic copic copter; and (e) inserting it as soon as possible with B and C, using the copic copic copher and the copic clif.

2) On December 26, 2020, the Defendant administered the scopon dose with B and C at the place indicated in paragraph (1) at around 13:00 on December 26, 2020, at the place indicated in paragraph (1) B and C, together with B and C.

3) On December 27, 2020, the Defendants administered philophones in the copon dose with B and C at the place described in paragraph (1) (B) around 12:00 on December 27, 2020 and at the place described in paragraph (1)(B).

2. Defendant B

A. On May 16, 2017, the Defendant violated the Immigration Control Act, entering the Republic of Korea as a visa exemption (B-1) and continued to stay in the Republic of Korea beyond the period of sojourn without obtaining permission for extension of the period of sojourn, despite the expiration of the period of sojourn on August 14, 2017.

B. The defendant, on December 25, 2020, who violated the Act on the Control of Narcotics, Etc. ( native 1) 1, 2020, administered phiphones, shall be subject to subparagraph 1.
