A defendant shall be punished by imprisonment for four months.
However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On August 7, 2014, the Defendant joined the Defendant’s house located in Seocheon-si B and 301, with access to “C”, which is an Internet sports soil site, and joined the Defendant’s office. The Defendant paid KRW 94,367 from “D” to “D,” which is an overseas settlement site connected with the above gambling site, using cyber money that was charged with the payment of KRW 94,367 with the Defendant’s name. If he meets the results of the games, he was paid cyber money at a fixed rate, and was paid with the remaining cyber money by exchange. From around that time to October 27, 2016, the Defendant visited the Defendant’s house and the Defendant’s office working in Gangnam-gu by means of the attached table, with the total amount of KRW 371,410,3710,00,000 by accessing the above cyber money by means of exchange of the remaining cyber money at a fixed rate.
Accordingly, the defendant, by issuing things similar to the sports promotion voting rights and providing property or property benefits to those who correctly predicted the result, was gambling by using the Internet sports soil site that provides property or property benefits.
