Reasons
1. Basic facts
A. 1) The Defendant Bar Card Co., Ltd. is a corporation that conducts business such as credit cards, pre-paid cards, debit cards, issuance, sales, and management (hereinafter “Defendant Bar Card”).
Defendant A Co., Ltd. (hereinafter “Defendant A”).
(2) The Plaintiffs are those who have used or used a credit card, etc. upon entering into a contract for the use of and financial transaction with Defendant Barun Card and a credit card, etc., under the Credit Information Use and Protection Act.
B. The concept of the card accident analysis system and the introduction card accident analysis system (hereinafter “FDS”) are introduced by all domestic credit card companies as a system to detect abnormal or fraudulent use due to theft, loss, forgery, etc. of credit cards. According to FDS, an analysis model is made based on statistical methods using large-scale card use information and pertinent customer information based on past accident transactions, and based on this, measures such as refusal of card approval are taken when it is discovered that abnormal types of transactions have occurred according to the statistical analysis pattern of the credit card use.
C. The Defendant Bar Card’s 1 FDS development services contract and Defendant Bar Card’s fDS provision of card customer information have been implementing FDS around 2006, and at that time, requested C or Defendant A to provide FD business services on a regular basis.
Defendant B is an employee of “C” from October 2009 to April 2010, and from September 2013 to December 2013, 2013 as employees of Defendant A, and is involved in the work of developing and installing FDS entrusted by the said company from Defendant Bar Card to December 2013 as a general manager of the project.
