Defendant shall be punished by a fine of KRW 3,000,000.

Criminal facts

Some of the facts charged were corrected.

1. No person who illegally issues a passport on June 1997 shall enter false facts in documents submitted to have the passport issued or reissued, or use other unlawful means to have the passport issued or reissued;

When the defendant was unable to enter Japan due to his past illegally staying in Jongno-gu, the defendant was issued a passport with the name of the family resident B attached with his photograph, used it to enter Japan. around May 1997, the defendant paid 1 million won to the non-resident of his name at his own coffee shop located in the Seocho-gu Busan Metropolitan Government, and then the defendant 2 copies of his photograph and the certified copy of his resident registration in B, etc. on June 10, 1997, and applied for the passport in the name of B attached with his photograph in the name of the Gu office (C) attached to the paper located in the transportation Dong-gu Seoul Metropolitan Government, Jongno-gu, Seoul Metropolitan Government on June 10, 1997 and affixed the following seal thereon.

6. On November 1, 200, the above passport was issued.

As a result, the Defendant received a passport by unlawful means, stating false facts in documents submitted to obtain a passport.

2. No person who exercises a passport issued under another person's name shall use a passport issued under another person's name;

Nevertheless, on June 22, 1997, the defendant presented B's passport in the name-free and non-entry and departure inspection to the public official in charge of non-entry and departure inspection who is aware of the fact, as in paragraph 1 at the examination site of the Kimhae Airport in Busan Gangseo-gu, Busan, and used it.

3. No one who enters false matters in a document submitted for the reissuance of a passport on July 11, 2016 shall enter false matters in a document submitted for the issuance or reissuance of a passport;

The defendant left Japan using the passport in the name of B attached with the defendant's photograph as above and had been illegally staying there. The defendant was found to have been illegally staying in Japan around July 8, 2016.
