1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Details of the disposition;
A. On May 2, 2017, the Plaintiff, while under the influence of alcohol of 0.15% on May 23:15, 2017, driven a Bsch Rexton car and changed from the Hosung Police Station to three-lanes among the six-lane roads in the front line of the front line, at the Hosung Police Station located within the 764 East-gu East-gu East-gu East-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-si, the Plaintiff: (a) caused the victim, who driven two-lanes in the same direction, to suffer the injury of the said victim; and (b) caused the said victim to suffer the injury of the Daco-dong-dong-dong-dong-dong-dong-car, Do-dong-dong-dong-dong-dong-dong-only vehicle to repair and damage the said damage.
(hereinafter “instant traffic accident.” Nevertheless, the Plaintiff immediately stopped and proceeded as is by violating the signal, etc., without taking measures to rescue the victim. B. On May 26, 2017, the Defendant issued a disposition to revoke the driver’s license (Class I, Class I, Class II, and Class II) against the Plaintiff on the ground that the Plaintiff was injured by the instant traffic accident and did not perform necessary measures or obligation to report under Article 54(1) or (2) of the Road Traffic Act (hereinafter “instant disposition”).
C. Accordingly, the Plaintiff filed an administrative appeal with the Central Administrative Appeals Commission, but was dismissed on August 31, 2017.
On the other hand, the Plaintiff, as seen above, was driving a drunk, caused the instant traffic accident by negligence in the course of business, thereby causing injury to the victim, and escaped without taking measures under Article 54 (1) of the Road Traffic Act, such as aiding the victim.
