Punishment of the crime

However, as the defendant already sold the above character and the item to another person, even if he received money from the injured party, he did not have the intention or ability to transfer the character and the account owned by the item.

The Defendant received 260,000 won from the damaged party to the corporate bank account in the name of P on the same day.

Accordingly, the defendant was given property by deceiving the victim.

2. On November 2, 2016, the Defendant, against the victim CE, takes a pop-up of 6S on the Internet website at a non-permanent place.

After posting the letter, the victim reported and contacted the letter, “If 500,000 won is remitted to the P business bank account (CF) in the name of the P, it would deliver mobile phones.”

However, since the defendant did not have the above mobile phone, even if he receives the money from the injured party, he did not have the intention or ability to deliver the mobile phone.

The Defendant received 500,000 won from the damaged party to the corporate bank account in the name of P on the same day.

Accordingly, the defendant was given property by deceiving the victim.

3. On November 2, 2016, the Defendant, against the victim CG, takes pop-up care of the victim’s three North Korean defectors on the Internet’s website at a closed place on the Internet.

If a victim, who reported and contacted a letter after posting the letter, transfers one million won to the P business bank account (CF) of the P business bank.
