1. All of the plaintiffs' claims are dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
Reasons
1. Basic facts
A. On March 4, 2004, D entered into an insurance contract (hereinafter “instant insurance contract”) with the beneficiary’s heir, termination of the insurance period, insurance amount of KRW 50,000,000, monthly insurance premium of KRW 59,500 as the beneficiary’s heir, beneficiary’s heir, insurance amount of KRW 50,000,000, and KRW 59,500 as the monthly insurance premium of KRW 50,000. The insurance contract and the terms and conditions of the instant insurance contract are as follows: (a) by a special agreement, the insurance period of March 4, 2050; (b) the insurance amount of KRW 150,00,000; and (c) the monthly insurance premium of KRW 6,000 as the insurance premium of KRW 6,00.
1. Non-distribution Trisome Policy [Attachment 1.2] Article 21 of the Terms and Conditions / [Types and Grounds for Payment of Insurance Money] (hereinafter “company”) shall pay the insurance money agreed to the beneficiary when any of the following events occurs to the insured:
1. When the insured dies during the insurance period or becomes disabled by class 1 in the list of disability classification table: Article 23 of the Insurance Money for the Death of Class 1 Disability [Insurance Accidents for which no insurance money is paid] (1) The Company may terminate this contract simultaneously with the failure to pay the insurance money or to exempt the payment of the insurance premium if any of the following events occurs:
1. Where the insured has intentionally impaired himself/herself, but this shall not apply where the insured has impaired himself/herself in a state of mental illness and where he/she has caused suicide or injury to himself/herself after two years from the date of commencement of responsibility for the contract (the date of reinstatement in cases of an inevitable contract);
2. Article 10 of the Terms and Conditions of the Special Agreement for the Death of Undividended Disasters [Types and Grounds for Payment of Insurance Money] Company shall specify the disaster classification table during the insurance period of this Special Agreement.
