A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant, along with the name influor who became aware of on the Internet, has attempted to acquire the cell phone from the cell phone store by using forged resident registration certificates.

1. On October 17, 2013, the Defendant: (a) sent his/her photograph by e-mail to those who have no name, and had them attach his/her photograph to the resident registration certificate of B and C’s driver’s license.

Accordingly, the Defendant forged the resident registration certificate and the driver's license for B in the name of the Bupyeong-do Busan Metropolitan City, which is an official document, for the purpose of uttering in collusion with those who have lost their names.

2.(a)

(1) Around 15:00 on October 20, 2013, the Defendant committed the crime against the victim D (1) on the forged public document uttering presented the forged public document’s driver’s license under the false name C to G employees who know of the forgery at (B)F store located in Dongjak-gu Seoul Metropolitan Government E, and exercised it.

(2) The Defendant forged a private document and the uttering of a private document indicated “C” in the name column of the written application for mobile phone subscription, written consent for the utilization of personal information, and written application for consent to the agreement, using a testing pen that was kept at the time and place specified in the foregoing paragraph (1).

As a result, the Defendant forged one copy of the application for mobile phone subscription in the name of C, which is a private document on rights and duties, and the written consent for the utilization of personal information and the written consent for the agreement, and issued the forged documents to G who is aware of such forgery at the same time and place as if they were the document duly formed.

(3) The criminal defendant presented a forged driver's license to G at the same date, time, and place as above (1) and issued a forged mobile phone subscription application, etc. as above (2) to G, thereby deceiving G as if he/she was C, and its affiliation is a mobile phone of the amount equivalent to KRW 1,067,000 of the market price owned by the victim D from G.
