Defendant shall be punished by a fine of KRW 5,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

On December 2, 2016, at the defendant's house located in Gangnam-gu Seoul, the defendant prepared a false complaint against C by using a computer.

The written complaint states, “Defendant C removed toilets without permission of the complainant for the reason that the external toilets owned by the complainant interfered with the construction of a new building while constructing a new building at the construction site located in Ansan-gu, Ansan-si, Ansan-si.”

However, in fact, the Defendant received contact that the Defendant is surveying the boundaries on the date of the removal of toilets and received a proposal from E, E, the construction owner C, which is the site site site, that the toilet dumpeds the boundary, and accepted it once again.

Nevertheless, on December 15, 2016, the defendant submitted the above complaint to the police officer in charge at the public service center of the Gyeyang-gu Police Station in Ansan-si.

As a result, the defendant brought C without prison labor for the purpose of having C receive criminal punishment.

Summary of Evidence

1. Each legal statement of witness F, G, C, and E;

1. The defendant and his defense counsel asserted that the defendant did not dismiss C, since he did not consent to the removal of the toilet when the defendant arrives at the scene after the survey.

The following circumstances acknowledged by the evidence adopted and examined by this Court, namely, C and E, the main owner of the construction, consistently show the result of the survey conducted by the Defendant at the location where the Defendant and his/her spouse, who had been contacted at the time of the survey and received consent from the Defendant regarding the removal and new construction of toilets.

The defendant and his spouse stated that they arrive at the site after hearing the end of the survey from the construction-related person through H, and confirm that red paintings have been tamped on one's building and toilet.
