Defendant shall be punished by a fine of three million won.
If the defendant fails to pay the above fine, 50,000 won shall be one day.
Reasons
Punishment of the crime
1. Violation of the Passport Act;
(a) No person who commits the crime on December 2, 2005 with the intention of exercising his/her passport shall be allowed to take over or borrow a passport under the name of another person;
Nevertheless, on December 2005, the Defendant was transferred with the purpose of using a passport issued by C in the name of C in the house plan of C, which is located in the Hasan-si B building 301.
(b) No person who commits the crime on December 31, 2009 shall enter false facts in any document submitted to obtain a passport, etc. or a travel certificate, or receive a passport, etc. by other unlawful means.
Nevertheless, on December 31, 2009, in order to have a passport reissued under the name of C issued by the Chinese Mine-gun, the Defendant submitted a written application for the reissuance of a passport to the said consul stating false facts, such as recording the name, resident registration number, etc. of C as he/she is C, and attaching his/her photograph.
Accordingly, the defendant stated false facts in the documents submitted to obtain a passport.
2. On December 2005, the Defendant: (a) transferred a passport in the name of C and his photograph, as described in paragraph (1), from a tea house in which it is impossible to identify the trade name located in Yongsan-gu Seoul, Yongsan-gu, Seoul; and (b) assigned the passport in the name of C and its photograph, and had him attach it to C’s passport.
Accordingly, the defendant, for the purpose of uttering, forged a passport for C in the name of the Minister of Foreign Affairs and Trade, which is an official document.
3. On January 4, 2006, the Defendant presented a forged passport to an immigration control employee who is not aware of the forgery at an international passenger terminal located in 1688, 168, 198, 2006, 3.2.
