1. 폭행 피고인은 2014. 12. 13. 23:00경 서울 양천구 C 앞길에서, 맞은편에서 걸어오는 피해자 D(31세)의 어깨를 치며 시비를 걸다가 죄송하다고 말하는 피해자 D에게 욕설을 하면서 주먹으로 피해자 D의 얼굴을 2회 때리고, 발로 피해자 D의 복부를 4회 찼다.

계속해서 피고인은 이를 말리는 피해자 D의 일행인 피해자 E(30세)의 얼굴을 주먹으로 2회 때리고, 발로 피해자 E의 가슴을 찼으며 피해자 F(31세)의 얼굴을 주먹으로 2회 때리고, 발로 피해자 F의 다리를 걷어차는 등 피해자들을 폭행하였다.
