Defendant
A shall be punished by imprisonment for four months and by imprisonment for eight months, respectively.
However, for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. The Defendants and C, D, E, F, G, H, I (former name “J”) and the Defendant A, B, C, and D were subject to false traffic accidents by K, and C are recruited by E, G, and I, and Defendant B recruited H, G, and I, and the Defendants conspired with C, D, E, F, G, H, I, and K to claim the insurance money and obtain the insurance money.
Therefore, around 02:30 on August 9, 2016, the Defendants intentionally shocked the back part of the Nitchip car, which Defendant A flows into H, G, and I, by driving D, E, and F on the Litccar rental car in front of the Gwangju East-dong, Gwangju-gu, Gwangju-gu, Gwangju-si, by carrying D, E, and F on the Litrate Mita car.
9. Around 16:21, at around 16:21, he/she falsely reported that Defendant A and D, E, F, G, H, and I were damaged due to traffic accidents.
As a result, the Defendants conspired with C, D, E, F, G, H, I, and K, by deceiving the victim as above, and the Defendants were paid KRW 9,043,100 as insurance money from the victim as shown in the No. 1 of the List of Crimes No. 1.
2. Defendants B and C, D, P, Q, R, S, T, and K’s joint criminal acts were subject to false traffic accidents from K, and Defendant B recruited O, T, P, Q, Q, Q, T, and R, and Defendant B conspired to commit intentional accidents together with O, D, P, Q, R, T, and K to claim the insurance money and obtain the insurance money.
Accordingly, on August 23, 2016, at around 22:00, Defendant B filed a false report with the victim Samsung-gu Fire Insurance Co., Ltd. on the following grounds: (a) on the Round-dong located in Gwangju Northern-gu Round, on a VYF YF strawet car that K is l, D with O, on board, and due to T to intentionally shock the back portion of the 5 passenger car of P, Q, R, and C, the L, and the k5 passenger car that K is carrying; (b) around 14:00 of the same month, Defendant B filed a false report with the victim Samsung-gu Fire Insurance Co., Ltd. as a traffic accident, and caused damage to the k5 passenger car.
Accordingly, Defendant B in collusion with O, D, P, Q, R, S, T, and K.
