A shall be punished by imprisonment with prison labor for eight months and by imprisonment with prison labor for one year.

Punishment of the crime

[Criminal Records] Defendant B was sentenced to one year of imprisonment and two years of suspended execution on December 18, 2015 due to the violation of the Act on Special Cases concerning Regulation and Punishment of Speculative Acts, Etc. at the Daegu District Court.

그럼에도 불구하고, 피고인들은 2017. 3. 초순경부터 같은 해 22. 경까지 위 게임 장에서 ‘ 천지 연’, ‘ 씨 앤 블루’, ‘ 야 경 등 총 90대의 게임기를 설치하여 불특정 다수의 손님들에게 속칭 ’ 똑딱이‘ 로 불리는 자동 진행장치를 사용하여 게임을 하도록 한 후 손님들이 획득한 점수에 대해 점수 보관 증(’ 딱지‘) 을 교부하고, 손님들 로부터 보관 증에 기재된 점수의 사용을 요구 받으면 기재된 점수 만큼 게임기에 입력을 해 주어 게임을 다시 할 수 있도록 함으로써 위 보관 증에 대한 교환가치를 부여함과 동시에 손님들이 보관 증을 다른 손님들에게 판매하여 현금화할 수 있도록 하고, 손님들 로부터 환전 요청을 받으면 보관 증에 기재된 점수 1 만점 당 수수료 10% 을 공제하여 현금 9,000원으로 바꾸어 주는 방법으로 환전하였다.
