Reasons
Punishment of the crime
[2] On March 21, 2008, the Defendant was sentenced to a suspended sentence of 8 months for larceny, etc. on March 2008; on March 20, 2009, the same court was sentenced to 8 months for larceny, etc. on November 4, 2010; on August 30, 2011, the same court was sentenced to 10 months for larceny; on August 30, 201, the Defendant was sentenced to 10 years for larceny; on September 12, 2012, the same court was sentenced to 2 years for imprisonment for violation of the Act on the Aggravated Punishment, etc. of Specific Crimes; on January 30, 2015, the same court was sentenced to 3 years for imprisonment for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes; and on April 13, 2018, the Defendant was sentenced to 3 years for the execution of the sentence from the prison (aggravated Punishment, etc.).
[Criminal facts]
1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes;
A. On February 17, 2021, around 03:36, the Defendant: (a) opened and entered into a door-to-face non-authorized lux SUV car that was parked in the vicinity of the Nam-gu apartment complex B, Ulsan-gu, Ulsan-gu without correction of the name or non-victimed SUV car; (b) and (c) cut off the victim with a paper-to-faced 42,50 billion won, including one box of wheel in the face value of 32,00 won at the market price, and one box of 12,000 won at the market price, and one string of 2,500 won at the 2,50 won at the market price.
B. On February 17, 2021, at around 03:54, the Defendant: (a) opened and entered a studio C Studio building parking lot in Ulsan-gu, Ulsan-gu, the victim D, who was parked therein; and (b) cut off the said car by driving the said car in the amount of KRW 2,00,000 at the market price, using the keys posted inside the vehicle, using the keys posted inside the vehicle.
Therefore, even though the defendant was sentenced to imprisonment at least three times due to larceny, the victims' property was stolen within the repeated crime period.
