1. The Defendant’s disposition of restriction on participation against the Plaintiffs on May 20, 2019 is revoked.

2. The costs of the lawsuit are assessed against the defendant.

1. Details of the disposition;

A. The Plaintiff Company A (hereinafter “Plaintiff Company”) is a corporation established for the purpose of development, production, and supply of software and multimedia, and the Plaintiff Company B is the representative director of the Plaintiff Company.

B. On July 1, 2017, the Plaintiff Company entered into an agreement with the Korea Creative Content Agency (hereinafter “instant task”) under which the Minister of Culture, Sports and Tourism entrusted with the planning, support, evaluation, management, etc. of research and development projects by the Minister of Culture, Sports and Tourism, with respect to the project period from July 1, 2017 to June 30, 2018, with respect to the task “D” (hereinafter “instant task”), the agreement on the support project with the Plaintiff, which provides the Plaintiff with the subsidy of KRW 260,00,000, and the managing director in charge of research and development projects.

C. Upon performing the instant task, the Plaintiff Company submitted a final report to the Defendant on July 31, 2018, and on September 4, 2018, the Defendant notified the Plaintiff Company of the final evaluation as a result of the Evaluation Committee’s final evaluation on the performance of the instant task.

On April 11, 2019, the Defendant held a disciplinary measure deliberation committee on the grounds of the Plaintiff’s use of research and development expenses for any purpose other than the purpose of use (unauthorized withdrawal of research expenses and submission of false evidence when settlement of research expenses). On April 15, 2019, the Defendant notified the Plaintiffs of the restriction on participation in national research and development projects for two years (from May 1, 2019 to April 30, 2021) pursuant to Article 27 of the Regulations on the Management, etc. of National Research and Development Projects and Article 40 of the Regulations on the Management of Culture and Sports and Tourism Research and Development Projects

E. The Plaintiffs filed an objection against the foregoing restriction on participation, the Defendant held a deliberation committee on May 14, 2019, and notified the Plaintiffs of the result of deliberation and sanctions that the foregoing objection was rejected on May 20, 2019, and the final result of sanctions [two years from June 1, 2019 to May 31, 2021].
