A defendant shall be punished by imprisonment for a term of one year and two months.

Seized evidence 1 or 2 shall be confiscated from the accused.

Punishment of the crime

[2016 Highest 850, the Defendant repaid personal loans worth KRW 50 million to the Defendant, employed a disguised job at a convenience store to raise the Internet gambling fund, and filled cash in transportation cards (e.g., Tick cards, carbing cards, etc.) using the chargeer of transportation cards, and intending to receive refund and use it as loan repayment and gambling funds.

1. On March 20, 2016, the Defendant served the first day as an employee at C convenience stores operated by the victim E in Gangdong-gu Seoul Metropolitan Government on March 20, 2016.

From 05:30 on the same day to 05:53 on the same day, the Defendant used the gap of work mixed in the same place, thereby making up 12 copies of transportation cards (e.g. tact cards) prepared in advance on the charging machine for the transportation cards managed by the said damaged person installed in the carcter at the same place, and entered information without authority, and filled up the total amount of 5,997,000 won over 120 times.

In this respect, the Defendant acquired property benefits as above.

2. Crimes of F convenience stores (thief and fraud by using computers, etc.);

A. On March 21, 2016, the day after committing the crime as above 1, the Defendant served as an employee from the F convenience store operated by the victim H in Gangdong-gu Seoul Metropolitan Government to the first day.

The Defendant, from around 03:43 to around 04:31 on the same day, took two copies of transportation cards equivalent to the total market value of 5,000 won owned by the said victim, using the gaps of work to be mixed in the same place.

Accordingly, the Defendant stolen another’s property as above.

B. The Defendant used computers, etc. at the above date and time, and at the above place, used transportation cards prepared in advance on the charging machine for the transportation cards managed by the said injured party (Taton Card 7, glock card 8), and two copies of the stolen transportation cards (Taton Card 2) as above.
