A defendant shall be punished by imprisonment for two years.

Punishment of the crime

The Defendant served as the head of the business division of C from April 2010 to February 2014, and the obligation from September 2013 to December 2013 to KRW 160 million was accumulated for several years, and there was no property.

1. Around September 15, 2013, the Defendant made a false statement to the victim D that “I will supply at a time to time money to 100,000 won for each share supplied by wholesale to KRW 33,00,00, KRW 26,000 for each share supplied by wholesale to KRW 37,000, KRW 26,000 for each share supplied by wholesale to KRW 15,00,00 for each share supplied by wholesale to KRW 15,00, and to pay money to the victim D at a time.”

However, the defendant did not have secured alcoholic beverages with dumping, and even if he received money, he did not have the intention or ability to supply alcoholic beverages equivalent to that amount.

The Defendant received KRW 71,060,000 from the victim on September 21, 2013 from the victim to the agricultural bank account in the name of the Defendant’s wife E, and acquired KRW 71,060,000 in total as the liquor price for 21 times until November 26 of the same year, such as the list of crimes in the attached Table (1).

2. When the Defendant was unable to be supplied with alcoholic beverages from the above C, the Defendant made a false statement that “G” heading F in Seocheon-gu, Seocheon-gu, Seocheon-si, stating that “The Defendant would give the payment to the customer in lieu of alcoholic beverages” to the victim, but the Defendant did not have any intent or ability to pay the payment.

Around December 23, 2013, the Defendant had the victim supply alcoholic beverages equivalent to KRW 5,613,00 in total to the amusement establishments near the Southern Southern Station, etc., thereby acquiring property profits from the victim equivalent to the same amount.

The Defendant of “2014 Highest 1581” shall be Incheon from April 6, 2010 to February 13, 2014.
