A defendant shall be punished by imprisonment for six months.

Punishment of the crime

The defendant is a person who works as an alcoholic beverage delivery worker in Nowon-gu, Seoul.

From July 2009 to June 2013, the Defendant has delivered alcoholic beverages to “F”, which is a restaurant operated by the victim E, from July 2009 to the early policeman.

1. The Defendant, while delivering alcoholic beverages, was able to have the sales invoice of alcoholic beverages that belongs to the quantity of alcoholic beverages stored and that is larger than the quantity of alcoholic beverages stored, by falsely preparing and delivering them.

On March 29, 2013, around 10:17, the Defendant: (a) prepared an invoice for alcoholic beverage sales as if he/she supplied 2 boxes and 6 boxes to the liquor storage place located in Songpa-gu Seoul Metropolitan Government (hereinafter “F”), and delivered the invoice to the victim; and (b) delivered only 1 boxes and 5 boxes in fact to the victim; (c) around that time, the Defendant got the victim to pay the sum of KRW 75,300,000 in total of KRW 42,70,000 in the market price of the said week (as in the case of wife) and KRW 32,60,000 in the market price of the said week.

In addition, from that to May 7, 2013, the Defendant had the victim pay the total amount of KRW 697,900 and the amount of KRW 697,900 to that of KRW 8 times as indicated in the attached list of crimes by means of the foregoing method, thereby having the victim obtain pecuniary benefits equivalent to that of the said amount.

2. Larceny;

A. On April 9, 2013, around 11:24, 2013, the Defendant: (a) took a delivery of alcoholic beverages at the place of storage of alcoholic beverages at the above “F” store; (b) took the 32,600 won of the market price on which alcoholic beverages are loaded, and stolen them.

B. On April 25, 2013, around 13:48, the Defendant: (a) took a delivery of alcoholic beverages at the place of storage of alcoholic beverages at an alcoholic beverage store; (b) 42,700 won of the market price on which alcoholic beverages are loaded at that place; and (c) stolen them.

C. On May 2, 2013, the Defendant, at around 10:53, alcoholic beverages at the place of storage of alcoholic beverages with the point of “F” (F).
