A shall be punished by a fine of KRW 1,00,00, by imprisonment with prison labor of KRW 6 months and fine of KRW 5,360,00.

Punishment of the crime

1. Defendant A, operating a fireworks with the trade name “I” from August 1, 2016 to the Gangwon-dowon H, was a person who supplies three kinds of funeral rites and unconstitutional flowers to the funeral hall in the J. K Medical Center.

On September 13, 2017, the Defendant made a solicitation to the effect that, as an employee of the above K Medical Center in the above K Medical Center, the Defendant would connect the orders of funeral for funeral stay to a private person who is in charge of the practice of funeral funeral in the above K Medical Center, to the extent that he can supply the funeral fireworks, such as in addition to the items agreed to be supplied, in addition to the items under the above contract to be supplied, such as influenite, infinite, and infinite harmony with three times.

When the Defendant sold 2,00,000 won or more from the above B, C, and D in accordance with solicitation, the Defendant delivered 40,000 won or more of the sales to B on the same day as introduction expenses.

From this point to January 13, 2018, the Defendant issued 2.68,00 won in total for 44 times, as indicated in the list of crimes in attached hereto, by delivering the funeral fireworks to the funeral hall of K Medical Center and delivering some of the sales proceeds to B, C, and D.

Accordingly, the defendant accepted a bribe in relation to the duties of the local medical center staff to be regarded as a public official.

2. Defendants B, C, and D are employees of the above K Medical Center, who take charge of the duties of controlling funeral services and selecting companies supplying fireworks used for funeral rites, and supporting the smooth progress of funeral services.

On September 13, 2017, the Defendants received a request from A to the same purport as that stated in paragraph (1) in the funeral hall around September 13, 2017, and upon receipt of a request from a resident in the funeral hall to take orders for funeral fireworks, the Defendants introduced A and received 40,000 won, which is part of the sales proceeds of the fireworks, from January 13, 2018.
