피고인은 2019. 7. 8. 16:00경 양산시 B에 있는 C에서 직원 및 민원인 등 6명이 있는 자리에서 그곳 사회복무요원으로 근무하고 있는 피해자 D(남, 22세)에게 “야이 개새끼야, 씨발 새끼야, 죽여 뿔라, 개씨발새끼 뭐 저런 새끼를 앉혀 놨어요, 뭐 이런 새끼가, 으이고 씨발 저거 죽였으면 좋겠다. 개새끼 내가 진짜로”라고 말하여 공연히 피해자를 모욕하였다.
