A defendant shall be punished by imprisonment for two years.
Reasons
Punishment of the crime
1. On September 13, 2002, the Defendant was sentenced to a three-year and six-month punishment due to robbery, injury, etc. at the Seoul Northern District Court (Seoul Northern District Court). On August 9, 2010, the Seoul Southern District Court received a summary order of a fine of three million won due to larceny.
Before a repeated crime, the Defendant was sentenced to imprisonment with prison labor for fraud, etc. at the Seoul Central District Court on November 22, 2007 and completed the execution of the sentence on November 20, 2008.
【Criminal Facts】
On June 3, 2015, the Defendant: (a) around 17:25, in “F” operated by the victim E (hereinafter referred to as “F”) in Jongno-gu Seoul Jongno-gu Seoul (hereinafter referred to as “F”); (b) as if he/she was a customer, he/she would be a gold bath, and (c) as he/she would be a member of the victim’s market price, would be 1,90,000 won of the victim’s market price; and (d) would be changed from the fake shoulder that he/she brought into his/her own seat by taking one string of net gold bars equivalent to 1,90,000 won of the victim’s market price; and (e) was stolen from February 21, 2010 to the above date, as described in the list of crimes by the foregoing method, from around 11, 200 to the above date.
Accordingly, the defendant habitually stolen the victims' property.
2. The Defendant: (a) made an appraisal of the scrap portion indicated as 18K generally by the gold banks; and (b) made it possible to determine the authenticity of the gold 18K; and (c) made it possible to obtain money from the victims by presenting the gold straw to the gold straw as if the gold straw was the whole gold straw; and (d) having the gold straw exchanged with other straw precious metal or cash, etc.
