Defendant D’s KRW 162,108,657 to Plaintiff A, KRW 150,798,158 to Plaintiff B, and KRW 9,370,249 to Plaintiff C, respectively.
Reasons
1. Basic facts
A. (i) A Co., Ltd. was established for the purpose of manufacturing and selling electronic equipment on May 24, 2000, and was listed on the KOSDAQ market on June 30, 2006. Around 2007, Samsung Electronic Co., Ltd., which was supplied the whole quantity of the Hy disc hedging that was assembled by G, Ltd., changed its main product group into the Hybb, thereby reducing sales and operating profits.
Shed Defendant D was the major shareholder and the representative director of G from February 23, 2001 to March 28, 2008.
Fidelity, on the other hand, after changing the trade name to E on September 6, 2011, G was merged into Defendant F Co., Ltd. (hereinafter “Defendant Co., Ltd”) on August 1, 2012 during the proceeding of the instant lawsuit.
B. Defendant D’s fraudulent unfair trading (i.e., 6,800 won per share) listed on the KOSDAQ market on June 30, 2006 (the public offering was 6,800 won per share) and around July 2006, the share price was 4,000 won lower than the public offering price, and the share price was 4,000 won and became hump from investors.
Accordingly, Defendant D, the representative director of G, has made differential distributions between general shareholders, largest shareholders, and related parties, and has made efforts to increase the stock price of G by purchasing shares with a borrowed name account in the name of executives and employees, conducting capital increase without compensation, but did not have any particular effect.
B. Defendant D spreads false facts in her name, tried to obtain profits from market prices by selling the shares issued by Company G, which he held, and through an interview with the media (hereinafter “instant media interview”) on eight occasions from February 27, 2007 to September 13, 2007, Defendant D’s size and degree of elevation, economic value of her name mines, whether the status of a producer of her name mine, whether the status of a producer of her name mine, the economic relationship between her name and meral mar, the economic relationship between her name and her name her name her name her, and the possibility of the business of manufacturing her name her name her name her.
