A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above sentence shall be suspended for three years from the date this judgment became final and conclusive.

Punishment of the crime

When the defendant did not receive the U.S. visa due to the absence of certain occupation or property, the defendant requested the Broker to forge the certificate of income, etc. to the Broker, and issued the visa normally, the defendant would give KRW 10 million when the visa was issued.

1. On May 2004, the Defendant forged official document and forged private document: (a) at a coffee shop near Jongno-gu Seoul Metropolitan Government, Jongno-gu, and (b) made 40,000 won in advance notification of personal information, etc. to the above name brokers; (b) made use of personal information of the Defendant, and the above name broker paid 40,000 won in advance; (c) stated “E”, “A”, “F” in the name of the corporation, “E”, “35,929,000” in the income column, “396,910” in the total fixed amount; and (d) made the seal of the head of the high tax office stating “G”, “A”, “management division” in the above name brok, “member column,” and “H number No. 4,” and “No. 4,000 in the column of “No. 35,96,910” and “No. 4,” in the above name H’s column.

Accordingly, the Defendant, in collusion with a name-free person, included one copy of a certificate of income under the name of the head of the High Tax Office, which is a public document, one copy of a certificate of employment under the name of the F, and one copy of a certificate of income tax collection under the name of the F, and one copy of a certificate of income tax collection under the name of the FH.

2. The Defendant on May 12, 2004 at the time of filing an application for issuance of the U.S. visa at the office of the office of the U.S. Embassy in Korea located in Jongno-gu Seoul, Jongno-gu, Seoul, for the issuance of counterfeit official document and the U.S. visa.
