A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.

Punishment of the crime

1. 공무집행방해 및 상해 피고인은 2015. 7. 16. 10:25경 경남 함안군 가야읍 광정리 소재 광정삼거리에서, 안전모를 착용하지 않은 채 B 씨티 ACE 110 오토바이를 운행하다가 단속되어 함안경찰서 C파출소 소속 경사 D로부터 운전면허증 제시를 요구받고, 위 오토바이 번호판을 조회해 본 결과 미등록 오토바이임이 발각되어 그 경위에 대해 질문받자, “다른 경찰관은 경고만 하고 잘 봐주는데 왜 그렇게 깐깐하게 하느냐, 처벌하려면 처벌해라”라며 자신이 제시한 운전면허증을 빼앗으려고 하면서 위 D를 밀치고, 손톱으로 오른쪽 팔을 할퀴는 등 폭행하였다.
