A defendant shall be punished by imprisonment for three years.

The defendant shall be ordered to complete the sexual assault treatment program for 40 hours.

Punishment of the crime

The Defendant is the security guard of Sungnam-gu, Sungnam-si B lending, and the victim C (Y, 39 years of age) is a resident of the above lending, who resides in the above lending, with several sexual intercourses from August 2018 to September 2018, and maintained Manam-gu and arranged the relations after September 2018.

A. On June 14, 2019, at around 00:37, the Defendant sent the recording file to the husband of the victim and threatened the victim by making the call to the victim for an unforeseen reason. At this point, the Defendant sent the recording file to the husband of the victim, “I do not see that the inside of the forum has lost her husband. I send the recording file to the victim. I do not know the fact of the sexual relationship with the victim.”

피고인은 2019. 6. 14. 02:00경 성남시 분당구 D건물 앞 E에서, 녹음파일을 남편에게 전달하지 않도록 진정시키기 위해 피고인을 만나러 나온 피해자에게 “한번만 안아보자, 내가 파일을 다 버리겠다”라고 말하며 피해자를 껴안고 피해자의 성기 부위에 자신의 성기를 밀착하여 옷 위로 성기를 맞대어 비비고, 계속하여 피고인의 차량 안으로 이동하여 조수석에 앉아 있는 피해자의 몸 위에 올라타 피해자의 성기 부위에 자신의 성기를 밀착시켜 옷 위로 성기를 맞대고 비볐다.

As a result, the Defendant: (a) threatened the victim with his husband, etc., thereby preventing the victim from resisting the victim; and (b) forced the victim to commit an indecent act.

B. On June 24, 2019, the Defendant called the victim at around 17:30.
