A defendant shall be punished by imprisonment for four months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[criminal records] On November 12, 2020, the Defendant was sentenced to six months of imprisonment with prison labor for a violation of the Act on Promotion of Information and Communications Network Utilization and Information Protection, Etc. (obscenity distribution) at the Jung-gu District Court on November 12, 202, and the above judgment became final and conclusive on November 20, 2020.

[Criminal facts] No person may distribute, sell, lease, or openly exhibit obscene codes, phrases, sound, images, or videos through an information and communications network.

1. On January 2, 2019, the Defendant posted an obscene image consisting of a total of 843 male and female members from January 2, 2019 to February 18, 2019, including a notice by accessing the obscenity “G” on the Internet bulletin board of the website F, and posting the obscene material of H, “H,” as shown in attached Table 1 of the List of Offenses Act.

Accordingly, the Defendant distributed obscene images through the information and communications network.

2. On December 1, 2018, the Defendant posted an obscene image on the website No. 3,187 pages of the building No. 2 of the Daegu-gu Building C, Daegu-gu, through access to the web lower website B’s Internet bulletin board, and by the adult male and female of the title “J” to make a sexual intercourse with the Defendant’s contribution by the adult male and female of the title “J”, and posted it as a profession, from December 1, 2018 to February 18, 2019, an obscene image on which 3,187 gender sexual intercourses were written from around December 1, 2018 to February 1, 2019.

Accordingly, the Defendant distributed obscene images through the information and communications network.

3. On June 1, 2018, the Defendant posted a notice in the manner of making obscene images of title N in the title “N” on the adult bulletin board of the 8 web lower site, such as K, which was known to the ordinary place of business at the studio B and the studio in Daegu-gu, Seo-gu, Seo-gu, Daegu-gu, and L-dong website, as shown in the attached Form M, I,O, F, P, Q, R, and S.
