Reasons
Punishment of the crime
On May 7, 2019, the Defendant conspired to receive insurance proceeds by intentionally taking advantage of B, C, D, and E with an insured company where the vehicle was insured with a traffic accident, and conspired to receive insurance proceeds. On the front of the "G University" located in Daejeon East-gu, Daejeon on May 7, 2019, B used HK3 vehicle and stopped on the direction, etc. at the same time. C, D, and E are on board the said 3 vehicle, and the Defendant was on board the said 3 vehicle, which was stopped as promised in advance by driving the said 3 vehicle under the J. J. S., which was owned by B, and was stopped as the front part of the said 3 vehicle of the said 3 vehicle, which was in front of the A.W. The Defendant received the above 3 vehicle from the said A.W. On the day of receiving the traffic accident by phone call from the victim K, which is an insurance company of the said A.W. 3 vehicle of the said A.W., the Defendant received the said 3 vehicle accident and received it.
The Defendant deceiving the victim as such with B, C, D, and E, and transferred KRW 1,350,000,00 each from the victim to each N account in his/her name on or around May 8, 2019. On or around June 25, 2019, the Defendant sent the victim a total of KRW 523,240,00 to the Obank account in his/her name in his/her name as a result of the agreement.
Accordingly, the defendant acquired insurance proceeds by insurance fraud in collusion with B, C, D, and E, and obtained insurance proceeds from third parties.
