1. Of the instant lawsuit, the part concerning the order to pay penalty surcharges as indicated in attached Form 1 dated September 15, 2014 shall be dismissed.

Basic Facts

The status of three companies, including the Plaintiff, etc., the Daelim Industry Co., Ltd., and Samsung C&T Co., Ltd. (hereinafter “Plaintiff, etc.”) constitute “business entity” under Article 2 subparag. 1 of the former Monopoly Regulation and Fair Trade Act (amended by Act No. 10166, Mar. 22, 2010; hereinafter “Fair Trade Act”) as those engaged in construction business.

Construction of bid fences for the construction of the vehicle base of the Gangnam High-speed Railroad (hereinafter referred to as the "construction of this case", and the bidding procedure is referred to as the "tender of this case") is a construction work for construction of tallying facilities, storage lines, other auxiliary facilities and the main vehicle base adjacent to the vehicle base for the maintenance and repair of high-speed rail vehicles to be operated in the Southern High-speed Railroad (hereinafter referred to as the "instant bidding").
