1. For the plaintiffs:
A. Defendant C and D jointly share KRW 41,000,000 and their related thereto from August 6, 2014 to July 3, 2015.
Reasons
1. Basic facts
A. On February 20, 2014, the Plaintiffs purchased real estate (1) from Defendant E, a real estate broker, concluded a sales contract to purchase KRW 2.43 billion (hereinafter “the instant sales contract”) with Defendant C, D, the real estate broker, for the purchase price of KRW 2.43 billion (hereinafter “the instant real estate”), and each registration of ownership transfer on March 3, 2014, from Defendant C, D, the Busan Shipping Daegu G G, 265 square meters, and H large 10 square meters (the instant land was owned by Defendant C and D; hereinafter “instant land”).
(2) In concluding the instant sales contract, the following special agreements were concluded:
1. The sales of this article is the same as this item on the day of the buyer, and the contract has been concluded after confirming the inspection of the main document. 2 The sales of this article is made by comprehensive transfer and acquisition under agreement between the buyer and the buyer.
B. (1) Access roads up to the second floor of the building of this case are installed and used by 24 square meters of neighboring land (hereinafter “the instant intrusion”). At the time of applying for a building permit, stairs up to the second floor through the first floor store of the building of this case and the entrance of elevators are designed to pass through the entrance. However, after completion, an illegal structure alteration (hereinafter “the instant illegal structure alteration”) which expands the space of the store of the first floor by blocking a passage from the first floor store of this case and causing a passage up to the second floor through the entrance of stairs and elevators.
(2) The Plaintiffs are using a site equivalent to 52 square meters in the front side of the instant building from the Maritime Daegu Office as a parking lot with permission to occupy and use public waters.
