Defendant shall be punished by imprisonment with prison labor for eight months and by imprisonment with prison labor for the crimes of Nos. 1, 2, 3, 4, 6, 7, and 8 in the judgment of Defendant, respectively.
Reasons
Punishment of the crime
On May 17, 2018, the Defendant was sentenced to one year of suspension of the execution of imprisonment for six months at the Incheon District Court for fraud, and the judgment becomes final and conclusive on May 25, 2018.
The Defendant is an individual who operates the manufacturing business by employing 10 full-time workers at the location of the Special Committee for the Settlement of Disputes in Gyeongsung-gun, Chungcheongnam-gun, Chungcheongnam-gun, without any trade name.
The Defendant, from June 7, 2016 to his/her place of business, worked as an entertainment worker at the above place of business, and on July 20, 2016, the Defendant did not pay 2,513,000 won in total of two workers as stated in the attached Table 1, 2, as stated in the attached Table 1, 2, as well as the attached Table 1, 2, as the amount of wages of 1,425,000 won on July 20, 2016.
The Defendant, as the representative of the “G” located in Gyeongnam-gun E (State), is an employer who ordinarily employs 15 workers and operates a business of manufacturing vessel components.
The Defendant is working in the above workplace from November 1, 2015 to July 31, 2016 as a person in charge of contact.
The retirement H’s wage of KRW 4,00,000, monthly wage of KRW 4,000,000, monthly wage of KRW 4,000,000, monthly wage of KRW 7 months, and KRW 12,00,000,00, as indicated in attached Table 2 Nos. 1, 2, 5, and 9, including the wage of KRW 28,601,00, total wage of KRW 28,601,000, was not paid within 14 days from the date of retirement without any agreement on extension of the due date between the parties.
The Defendant in violation of the Labor Standards Act of 2018 Godan957 is an individual employer who employs four full-time workers within theJ located in Gyeongsung-gun I and operates steel structure manufacturing business without any trade name.
When a worker dies or retires, the employer shall pay the wages, compensations, and other money or valuables within 14 days after the cause for such payment occurred.
Nevertheless, the Defendant, from March 30, 2018, worked as a cook at the above workplace from around March 30, 2018, and was employed on April 1, 2018 by K workers retired from office.
