1. The purchase and sale contract between the Plaintiff and the Defendant on February 23, 2015 for the Ulsan-gu C Site 90.4 square meters is the Defendant.
Reasons
1. Basic facts
A. On February 23, 2015, the Plaintiff entered into a sales contract (hereinafter “instant sales contract”) with the Defendant and the Plaintiff on July 90.4 of the Ulsan-gu C Site owned by the Plaintiff on the following: (a) the Plaintiff entered into a sales contract with respect to the said land and building (hereinafter “instant real estate”). The main contents are as follows:
The seller refers to "A" and the buyer and one other than the defendant "B" are referred to as "B" for the real estate signs, etc. under the real estate sale and purchase contract (including land, buildings, and fixtures).
The purpose of this Agreement is to purchase the following transaction objects from “A” and the land for the neighboring project site (hereinafter referred to as “project site”) from “A” and to construct multi-family housing, and this Agreement is, on the premise thereof, to fully recognize that “A” and “B” are and to fulfill their mutual rights and duties in order to achieve the objectives.
Article 1 (Indication of Tradeed Real Estate) "A" shall be sold to "B" under the ownership of "A".
With respect to the sale of the real estate in Article 2 (Sale Price and Method of Payment) of the area of the land in Jung-gu Seoul Metropolitan City in Ulsan Metropolitan City, the purchaser shall pay the purchase price to the seller by the following method of payment:
In the case of total purchase price: Down money shall be paid at the rate of the amount divided into one hundred million won (Won 1,600,000,000) and at the time of conclusion of a sales contract for a parcel of at least 10% of the total project site subject to deposit in a bank account at least 90% of the total amount.
Considering that it is a multi-family housing project of "B," a bank account deposit account deposit account payment of KRW 90 percent, the payment shall be made within six months after the approval of the competent authority for the project.
Article 3 (Transfer of Ownership and Consent to Land Use) When transferring the ownership of a project site, "A" is defective in the specification of the property owned.
