The judgment below

The part on Defendant N is reversed.

Defendant

The pronouncement of a sentence against N shall be suspended.

1. The summary of the grounds for appeal is unreasonable because each sentence (a fine of KRW 700,00,000 for Defendant K and each fine of KRW 500,00 for the remaining Defendants) declared by the court below to the Defendants is too unreasonable.

(2) The defendants N and Q had already been punished by a fine more than the fine amount (1 million won or three million won) of the summary order in consideration of the above favorable circumstances and the economic situation of the above defendants, etc., although the court below has already been sentenced to a fine more than the fine amount (1 million won or three million won) of the summary order, considering the above favorable circumstances and the above defendants' economic situation, it is unreasonable to accept the above defendants' assertion that the above defendants' grounds for appeal other than the defendant N did not reach an agreement with the victim and the victim want to be punished, and it is too unreasonable to the extent that the sentencing of the court below should be reversed.

Accordingly, the appeal by the remaining Defendants except Defendant N is dismissed in accordance with Article 364(4) of the Criminal Procedure Act, and since Defendant N’s appeal is well-grounded, it is reversed in the judgment below pursuant to Article 364(6) of the Criminal Procedure Act, and it is again decided as follows.
