A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
[Criminal Records] On November 19, 2015, the Defendant was sentenced to 8 months of imprisonment with prison labor and 2 years of suspended execution due to the charge of forging private documents at the Jeonju District Court on November 19, 2015, and the said judgment became final and conclusive on November 27, 2015.
[2] On November 28, 2012, when Defendant 1 concluded a check contract with IBK Industrial Bank of Korea IBK from August 20, 2009, he/she issued a check to secure the amount of the loan and accordingly, the Defendant 2 was the president of the H hospital located in Y in Yansan-gu Seoul Special Metropolitan City. From around August 20, 2009, he/she refused to pay the loan to J, etc. by January 28, 2015. However, he/she refused to pay the loan to J, etc. by January 2015.
In this situation, the Defendant, in order to avoid the payment of the amount of check or the suspension of transaction offered by the J, presented to the Bank the check held by the J for the repayment of the obligation and received a disposition of suspension of transaction due to the concerns that the hospital operating the check would be the date of default.
1. On January 26, 2015, the Defendant issued a check number L, a check number of KRW 100,000,000 in the name of the Defendant who is the blank of the payment deadline and recovered from J on February 3, 2014 while borrowing KRW 50,000,000 from J on February 3, 2014, the Defendant changed the face value of KRW 50,000,000 in the name of the Defendant’s seal imprint and affixed his/her seal impression on his/her own, thereby forginging the above check by J.
A false report was made.
2. On January 27, 2015, the Defendant issued a copy of check number M, face value 95,00,000, and a copy of check check in the name of the Defendant, as of December 22, 2014, to J on October 13, 2013, the Defendant paid 43,000,000 won to J by December 22, 2014.
