1. The plaintiff's claim is dismissed.

1. Basic facts

A. On March 5, 1999, the Plaintiff entered into an insurance contract with the Defendant as the insured, and entered into a non-dividend comprehensive health insurance contract (hereinafter “instant insurance contract”).

According to the instant insurance contract, the Defendant agreed to pay KRW 24 million per month for 24 months each month, and KRW 4 million at the time of diagnosis and determination as upper cancer.

B. Of the terms and conditions of the instant insurance contract, the contents pertaining to this case are as follows.

Article 2(1) of this Agreement refers to diseases falling under the following of cancer, heart disease, high blood pressure, cerebrovascular disease, liver disease, urine disease, chronic urine disease, chronic urgical disease, urgical disorder, Athrost failure, tuberculosis, tuberculosis, waste convergence, and urgical urgical disease.

1. “Crance” means a disease classified as malicious life in the Korean Standard Disease Classification;

However, the symptoms are insignificant-cell new life and flat-personal life, of which symptoms fall under the classification number C44 of Table 2, set forth in the preceding classification, set forth in the preceding classification. However, it is excluded from the said classification.

2. (2) The diagnosis and confirmation of cancer shall be made by a person who holds a professional doctor's license of autopsy pathology or clinical pathology, and this diagnosis shall be based on the present opinion about the organization or blood test;

However, if it is not possible to conduct the above pathological diagnosis, the clinical diagnosis of cancer is admitted as evidence of cancer.

In such cases, I shall have a documented record or evidence proving that the insured has been under diagnosis or treatment as cancer.
