Defendant
A and B shall be punished by a fine of KRW 5 million, and Defendant C shall be punished by a fine of KRW 2 million.
The above fine is imposed against the Defendants.
Reasons
Punishment of the crime
Defendant
A is a person who operates E in Jindo-gun, and Defendant B is a person who operates a salt farm located in the F of Jindo-gun, and Defendant C is a person who operates a Kim G in the vicinity of Jindo-gun G.
1. A person who intends to conduct a hazardous chemical business of Defendants A and B shall obtain permission from the Minister of Environment for each type of business after submitting related documents in advance, as prescribed by Ordinance of the Ministry of Environment, and shall not conduct a hazardous chemical business or handle hazardous chemicals without obtaining permission or after obtaining permission by fraudulent means, with facilities, equipment, and technical personnel meeting the standards prescribed by Ordinance of the Ministry
Nevertheless, in early October 2019, the Defendants did not obtain permission to conduct hazardous chemical business from the Minister of Environment, while Defendant A took part in the purchase, sale, and transportation of inorganic salt acid, Defendant B took part in keeping and transporting inorganic salt acid, and conspired to sell hazardous chemicals to the operator of Kim Gam-type.
Accordingly, in October 2019, Defendant A purchased an inorganic acid 11,200 liters, which is a hazardous chemical, from a sales company in the Habman B, and Defendant B stored the above inorganic acid in the Jindo-gun F.
Defendant A and B sold 3,220 liters of inorganic acids in custody as above to Defendant C in December 2019, and KRW 966,000, and KRW 3,980, around 15, 2020, respectively, to Defendant C around February 25, 202.
Accordingly, Defendants treated hazardous chemicals without obtaining permission from the Minister of Environment.
2. No person who accused C shall keep or use toxic chemicals provided for in the Chemicals Control Act for the purpose of cultivating fishery resources or removing foreign substances attached to fishing implements or fishing nets;
