Punishment of the crime

[criminal history] On January 19, 2011, the Defendant was sentenced to ten months of imprisonment with labor for the violation of the Act on Special Cases concerning the Settlement of Traffic Accidents in Daegu District Court and completed the execution of the above sentence on October 7, 201. On January 27, 2016, the Defendant was sentenced to two years of suspension of execution for eight months of imprisonment with labor for a crime of violating road traffic law in the Daegu District Court Port Support for the Daegu District Court. The judgment became final and conclusive on February 4, 2016, and is currently under suspension of execution.

[Fact-finding] The defendant is married between the victim C (43 years of age, female) and the victim C (6 years of age, female) on June 2002, and the victim D (6 years of age, female) is the second parent of the defendant and the victim C.

1. 상해 피고인은 2013. 3. 6.부터 같은 달 8.까지 사이 20:00 경 경주 E, 103동 903호에 있는 피고인의 주거지 안방에서 술에 취하여 피해자 C(39 세 )에게 성관계를 요구하였으나 피해자가 이를 거절하였다는 이유로 피해자를 도망가지 못하게 한쪽 구석으로 몰아넣은 뒤 주먹으로 피해자의 머리를 수회 때리고 발로 피해자의 몸을 수회 찼으며, 계속해서 손으로 피해자의 머리채를 잡아당기고 양손으로 피해자가 입고 있던 티셔츠와 속옷을 모두 찢어 버리는 등으로 폭행하여 피해자에게 약 2 주간의 치료가 필요한 흉곽 전벽의 타박상 등을 가하였다.

B. Paragraph (2) that the Defendant violated the Child Reinstatement Act (child abuse) against the victim D

A. During the time and time of recording and at the same place, the second son, who assaulted C as above, caused the victim to take the part of the victim's entrance only once on the ground that the victim said son’s son’s son’s son’s son’s son’s son.
