Defendants shall be punished by imprisonment for ten months.

However, the execution of each of the above penalties for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Defendant

A is the representative of E farming association selected as a subsidized business operator of the 2009 high-quality rice community promotion project from the elderly group, and Defendant B is the representative of F, and Defendant B knew that the above E farming association was selected as a subsidized business operator as the above, and so arranged the purchase of metropolitan pest control devices sold by G to Defendant A. When Defendant B was selected as a subsidized business operator of the 2009 high-quality rice community promotion project implemented by E farming association corporation as the representative of Defendant A in the elderly group, the E farming association corporation was selected as a subsidized business operator of the 2009 high-quality rice community promotion project, the former would reduce the amount of money to Defendant A, such as refunding self-charges and vehicle subsidies when purchasing metropolitan pest control devices sold by G stock company. After Defendant A consented to this, Defendant A applied for subsidies for the above business by purchasing agricultural machinery from G corporation to set the actual purchase price higher than the actual price.

On April 10, 2009, the Defendants purchased one metropolitan pest control unit of G Co., Ltd. from around 86,200,000 won in the warehouse near Defendant A, which is located in Gyeongbuk-gun H.

Nevertheless, Defendant A falsely prepared a request for subsidy to the effect that “the subsidy amounting to KRW 144 million, and KRW 36 million,” as if he purchased the subsidy amounting to KRW 180,000,00,000, which was set out at the expense of the subsidized project, including 20% of the above metropolitan pest control devices, was submitted to the person in charge of the elderly military administration

As above, the Defendants deceiving the person in charge of the elderly military administration and were granted subsidies of KRW 144 million from the elderly victim group around April 27, 2009 (Doviby KRW 36 million, military expenses of KRW 18 million).

As a result, the Defendants conspired to deception the victim by deceiving the victim.
