A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
1. From early 08:10 on December 2, 2012 to early 08:40 on, the Defendant acquired a letter of credit card of the Korean bank, the victim C lost, before the opening of the light-sponsed Station 7, the light-sponsing Sponsing Station in the optical-sponsing-dong, from the early 08:40 on the early 08:40.
The Defendant did not follow necessary procedures, such as returning the acquired property to the victim, but did so.
Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.
2. Larceny;
A. At around 22:00 on December 9, 2012, the Defendant released KRW 900,000,000 in total, on three occasions, a total of three hundred thousand won at one time, by inserting a personal identification card issued by a national bank C in the name of the victim, a stock company established on the first floor of Jongno-gu Seoul Metropolitan Government, Seoul Metropolitan Government, under the aforesaid paragraph (1), and inserting a password attached by combining the card by C, and withdrawing KRW 300,000,000.
Accordingly, the defendant stolen the victim's property.
B. The Defendant, from December 9, 2012 to 23:00 on December 9, 2012, from around 22:37 to 23:00, at the cash withdrawal period managed by the Seoul Yeongdeungpo-gu Seoul Metropolitan Government E and the Seoul Metropolitan Government E E and F’s branch office.
In the same way as the paragraph, 300,000 won was withdrawn at 17 times in total.
Accordingly, the defendant stolen the victim's property.
C. At around 08:00 on December 10, 2012, the Defendant: (a) from the cash withdrawal machine managed by the victims’ North Korea Agricultural Cooperative established at the forest management division located in the 96-3 YY-dong, YY-dong, the Defendant:
In the same way as the paragraph, 700,000 won was withdrawn in total over eight times in total.
Accordingly, the defendant stolen the victim's property. D.
The defendant around 21:12 on December 10, 2012, the defendant is managed by the defendant bank of the victim corporation, which is established at the Dong-dong branch of the Guro-gu Seoul Metropolitan Government, Guro-gu.
