1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. The fact that the registration of ownership transfer as stated in the purport of the claim (hereinafter “registration of this case”) has been made on February 10, 1993 for the real estate of this case, which was registered under the original name of the plaintiff, on the ground of sale and purchase on February 10, 1993, on March 9, 1993, is not in dispute between the parties or according to the evidence No. A. 1.
2. The Plaintiff’s assertion and determination are invalid by virtue of the title trust agreement between the original and the Defendant, and even if not, C, its mother, who is the original and the Defendant, arbitrarily forges documents required for registration and makes it invalid. The Plaintiff seeks cancellation of the above registration against the Defendant.
However, a title trust agreement was concluded between the original and the defendant only with the descriptions of Gap's evidence 3 and 4 and the testimony of witness D.
The plaintiff's above assertion is without merit, since it is insufficient to recognize that C has forged the documents required for registration of this case, and there is no other evidence to acknowledge it.
3. Conclusion, the plaintiff's claim is dismissed as it is without merit.
