Punishment of the crime
[Attachment] Defendant A is a person who operates F to engage in special cargo transportation business in the name of E using 13 cargo vehicles listed in the attached list of crimes owned by Defendant D, etc., and Defendant B is a person who operated H gas station in the Chungcheong-dong G from around 2004 to July 4, 2017, and Defendant C is a person who acquired H gas station from Defendant B and operated from July 5, 2017.
In order to alleviate the economic burden of oil providers on increased oil tax due to the reorganization of energy tax system, the oil subsidy system is being implemented, and when a cargo truck operator pays oil expenses with an oil purchase card (transaction card) designated for each cargo vehicle, and pays oil expenses with an oil purchase card connected thereto, the competent authorities (local governments) without any separate procedure of procedure will refund oil subsidies (345.54 won per liter) corresponding to the oil content to the passenger truck operator.
【Criminal Facts】
1. On September 2015, Defendant A and Defendant B conspired to receive fuel subsidies from the competent administrative agency by fraudulent or other illegal means by filing an application for fuel subsidies equivalent to the amount of the lost amount with the local government in a manner that keeps the said Chapter 13 in the oil purchase card (transaction card) and the oil purchase card (physical card) issued with respect to the said 13 cargo vehicles.
The Defendants, around September 20, 2015, around H20:08, sold the D cargo vehicle operated by the article in the name omitted from the Defendant’s name, which was operated by the article in the H gas station. However, the Defendants, upon receiving the instructions from the Defendant B, had the H gas station’s name unrecognified amounted to KRW 315 liter (401,625 won) with the said cargo vehicle purchase card (transaction card, card number: I) and KRW 345 liter (439,875 won).
