The defendant's appeal is dismissed.
Reasons
The punishment sentenced by the court below (one year and six months of imprisonment) is too unreasonable.
Judgment
If there is no change in the conditions of sentencing compared to the original judgment in the appellate court, and the sentencing of the original court is not beyond the scope of reasonable discretion, it is reasonable to respect
(see, e.g., Supreme Court en banc Decision 2015Do3260, Jul. 23, 2015). The Defendant appears to have committed a crime and committed a mistake, the Defendant has no record of punishment due to a sexual crime, and the Defendant is not adequate to economic and environmental circumstances, such as lodging and lodging in a marina shop where the Defendant works as an employee, and the fact that the instant crime was committed in relation to the attempted crime is favorable to the Defendant.
However, the crime of this case is committed by the defendant, who is an employee of marina branch, attempted to rape a customer regardless of whether he/she was married, and is accompanied by a high-level indecent act in the process, and the victim seems to have suffered significant mental suffering due to the crime of this case, however, there is no change of damage, the defendant did not receive a letter from the victim, and other various sentencing conditions in the records and arguments, considering the fact that the defendant did not receive a letter of suspicion from the victim, and the conditions of sentencing favorable to the defendant, the defendant cannot be deemed to have exceeded the reasonable scope of discretion because the sentence of the court below is too excessive, and there is no significant change in sentencing conditions compared to the court below.
Therefore, the defendant's assertion is difficult to accept.
The defendant's appeal is dismissed on the ground that it is without merit.
