Punishment of the crime

4. 피고인은 2010. 11.경 인천 이하 불상지에서 전화를 이용하여 사실은 피해자의 팬티가 쇼파 밑에 있었던 사실이 없음에도 불구하고 F에게 “C(피해자)는 남자관계가 복잡하다. 공연을 다녀왔는데 C의 팬티가 쇼파 밑에 나뒹군다.”라고 말함으로써 공연히 허위 사실을 적시하여 피해자의 명예를 훼손하였다.
