A defendant shall be punished by imprisonment for not less than one year and six months.

Of the facts charged in the instant case, violence against the victim D is committed.

Punishment of the crime

The Defendant displayed the door of the buckbucks to the merchants operating in the Nam-gu, Incheon. The Defendant was sentenced to organized violence in the past, neglected as if he had the right to control the street by working in the F, followed the Defendant’s money and valuables under the name of the bucker, which would not be able to perform funeral or assault the horses without hearing the horses, and raised money by taking the buckbucks, the number of days, goods sales, etc.

1. 폭력행위등처벌에관한법률위반(집단ㆍ흉기등상해) 피고인은 2007. 2. 8. 00:30경 인천 남동구 G 사무실에서, 위 E에 있는 피고인 관리의 떡볶이 노점에서 종업원으로 근무하는 피해자 H(24세)에게 매월 250만 원의 자릿세를 상납하면서 장사를 하라고 요구하였으나 피해자가 동거녀와 상의한 후 이를 거절하였다는 이유로, 피해자에게 “이 씹할 놈아 너는 줏대 없이 여자 말을 듣느냐”라고 욕설을 하면서 위험한 물건인 야구방망이로 피해자의 오른팔을 때려 피해자에게 치료 일수 미상의 오른쪽 팔 부분의 염좌상 등을 가하였다.

2. 공갈 피고인은 위 제1항과 같은 일시, 장소에서 위와 같은 폭행으로 겁을 먹은 피해자 H에게 “장사를 하기 싫으면 떠나기 전에 다음 사람에게 인수인계를 해주고 가라”고 말하여 피해자가 그 무렵부터 약 2개월 동안 위 떡볶이 노점 자리에서 장사를 할 I에게 떡볶이 장사를 가르치도록 하였다.
