The judgment below

The remainder, excluding the dismissed part, shall be reversed.

A defendant shall be punished by imprisonment for four months.

Reasons

1. Of the facts charged in the instant case, the lower court sentenced workers C, D, E, F, and G to the dismissal of public prosecution on the ground that each of the above workers withdraws his wish to punish after the prosecution, and sentenced the rest of workers to eight months of imprisonment and two years of suspended execution, recognizing that the violation of the Labor Standards Act and the violation of the Guarantee of Workers' Retirement Benefits Act were guilty.

However, the defendant appealed against the guilty portion among the judgment of the court below, and since the prosecutor did not appeal against the judgment of the court below and the above dismissal of the public prosecution becomes final and conclusive, the scope of this court's judgment is limited to
