Punishment of the crime
[B] The Defendant is a daily reporter, and the Defendant’s wife and the victim B (the age of 39) sent their children to C workplace child care centers on May 2019, and the Defendant, upon finding text messages, etc. between his wife and the victim and thought that the Defendant was in a close relationship higher than that of his wife and the victim. From around that time, the Defendant demanded the victim not to access the Defendant’s wife and visit the victim’s child and prohibit the victim’s C workplace child care center, etc., and if the victim does not hear it, the Defendant sent text messages, e-mail, etc. to the effect that it is not confirmed that the victim’s workplace company, such as the director general of the bureau, etc., maintains an inappropriate relationship between his wife and the victim’s child care center, etc. using his identity in daily newspapers, and if the victim does not hear such request, he act as doing any harm to the victim’s life or body.
【Criminal Facts】
1. On July 11, 2019, the Defendant sent text messages, etc. several times at C Child Care Center in Jung-gu, Seoul on July 11, 2019, at C, Jung-gu, Seoul, to the victim B (the age of 39) on several occasions, the Defendant committed an act as if he/she would threaten the victim or his/her children's body or life by putting a paper for A4 printed with the phrase "F (the age of 2) of the victim's son F (the age of 39) in the front of the second floor E of the workplace child care center."
Accordingly, the defendant threatened the victim.
2. On July 31, 2019, the Defendant of intimidation and damage to property: around 09:19 on July 31, 2019, discovered that, even after the act of the above paragraph 1. in the workplace child care center in the above C C C around July 31, 2019, the Defendant still sought the victim’s child to be placed in the workplace child care center, and thereafter, the victim’s son at the new site.
