1. The Defendant: (a) from November 7, 2015, with respect to Plaintiff A, KRW 28,381,300, KRW 11,274,340, and each of the above amounts.
Reasons
1. Details of ruling;
(a) Project approval and public notice - Project name: C Housing redevelopment and rearrangement - Public notice: September 5, 2013 - Project implementer D- Project implementer of Dongdaemun-gu: Defendant
(b) The Seoul Special Metropolitan City local Land Tribunal’s ruling of expropriation on September 18, 2015 - Land to be expropriated and goods to be expropriated, and compensation for losses: as shown below (attached Table 1):
(hereinafter referred to as "Seoul Dongdaemun-gu Edong" is referred to as "Edong"): - The commencement date of expropriation: November 6, 2015 - An appraisal corporation: two appraisal corporations, two appraisal corporations, and Dong-in appraisal corporations.
C. The Central Land Expropriation Committee’s ruling on March 24, 2016 - The amount of compensation for the Plaintiffs as indicated below [Attachment 1] - The appraisal corporation and the central appraisal corporation (hereinafter “each appraisal” as well as the appraisal of expropriation”) shall increase the amount of compensation for the Plaintiff’s land and goods to be expropriated as indicated below: 21/210 shares in the amount of compensation for the Plaintiff’s land and goods (unit: KRW 20,964,700 3,050,050 G G 171㎡ 775,339,65,65,000 H 21/210 shares in the amount of compensation for the Plaintiffs: 3,57,640,640 or 2400 square meters; 21/210 shares in the amount of compensation for the Plaintiff’s land and goods to be expropriated as indicated below; 360,975,970,9739,740,79,709,79,79,7040,7, etc.
2. The assertion and judgment
A. Each judgment by the plaintiffs' assertion is unfair by excessively low evaluation of each land to be expropriated and goods of this case. Thus, the defendant should pay the difference between the plaintiffs' reasonable compensation amount and the fair compensation amount.
B. 1) Determination 1) A certified public appraiser J affiliated with the Korea C&T Appraisal Corporation that conducted an appraisal upon request by this Court (hereinafter “court appraisal”).
As regards each land to be expropriated in this case, the special-purpose area, utilization status, land category, surrounding environment, etc. shall be the comparative standard land.
