Punishment of the crime

The defendant is a business owner who operates a general restaurant "C" on the second floor of Daejeon Jung-gu.

A person who sells or provides agricultural and fishery products or the processed products thereof after cooking shall not make a false indication of the place of origin or make an indication likely to cause confusion therewith.

피고인은 2015. 3.경부터 2016. 1. 19.까지 사이에 대전 대덕구 오정동 72-16 (주)미트갤러리에서 미국산 막창 1,569kg 13,281,000원, 차돌박이와 양지삼겹 725kg 5,413,000원 등 미국산 소고기 부산물 총 2,294kg, 18,694,000원 상당을 구입하여 이중 1,935kg, 15,957,000원 상당을 본인이 운영중인 업체 C식당에서 곱창모듬구이, 막창, 치즈듬뿍막창 등으로 조리하여 업체를 찾는 손님들에게 약 150,062,190원 상당을 판매하면서 식당 내ㆍ외부 플래카드, 대형인쇄물, 배너, 현수막, 나무메뉴걸이 등에 한우소막창, 국내산한우모듬구이, 한우모듬구이 등으로 마치 국내산 한우만 사용하는 것처럼 원산지를 거짓 표시하거나 소막창 국내산 한우ㆍ미국산으로 표시하는 방법으로 막창의 원산지를 혼동하게 할 우려가 있는 표시를 하였다.
