1. The defendant A shall be punished by imprisonment for one year;

The evidence of seizure No. 9 shall be confiscated from evidence No. 1.

No one shall engage in the business of giving users property gains or losses according to the incidental outcome using machines, instruments, etc. which are feared to attract speculative spirit, such as speculative electronic gaming machines.

피고인들은 I, 성명불상자들과 2012. 7.경 대구 달서구 J에 있는 ‘K 오락실’에서 이용자가 화면에 출현한 30장의 카드조합 중에서 동일한 카드를 능력으로 찾아내어 당첨되고 1,000회의 게임이 종료되어야 이미 출현한 카드조합과 동일한 조합이 출현되도록 등급분류 받은 ‘적벽대전Ⅰ’ 게임기와 달리, 동일한 카드조합이 연속하여 출현하면서 자동진행장치인 속칭 ‘똑딱이’를 버튼위에 올려놓고 자동으로 당첨될 수 있도록 하는 등으로 변조된 사행성 전자식 유기기구인 ‘적벽대전Ⅰ’ 게임기 50대를 설치하고, 피고인 A, 성명불상자는 게임장에 자금을 투자하여 게임기를 구입한 후 게임장을 총괄 운영하는 역할을 맡고, 피고인 B은 단속시 실제업주라고 진술하는 소위 ‘바지사장’ 역할을 맡고, 피고인 D, I은 게임장을 총괄 관리하는 역할을 맡고, 피고인 C, 피고인 E, 피고인 F은 손님들의 심부름을 하는 종업원 역할을 맡고, 성명불상자는 손님들이 게임물의 이용을 통하여 획득한 경품을 환전해주는 역할을 맡는 방법으로 위 게임장을 운영하기로 순차 공모하였다.

From July 2012 to October 12, 2012, the Defendants, along with I and I, installed 50 game machine “I” revised in the above “K Entertainment room” and provided them for the use of an unspecified number of customers who found the above game room.

The Defendants shall exchange 4,500 won per piece of gift, upon request by I, persons without name, and customers for the exchange of premiums obtained through the use of the said game.
