1. Defendant (Appointed) E shall be the Plaintiff

1. Basic facts

A. The Plaintiff is the owner who completed the registration of transfer of ownership on the ground of sale on August 7, 1998, No. 73275, which was accepted on August 7, 1998, with respect to F.75 square meters in Jeonju-gun, Jeonju-gun (hereinafter “Plaintiff’s land”).

The process of the change of ownership by the owner of the previous vessel to the plaintiff is as follows:

B. Defendant E completed the registration of ownership transfer on the ground of family inheritance on January 31, 1973, the Jeonju District Court Decision No. 2537, which was accepted on January 31, 1973, as to the land adjacent to the Plaintiff’s land, J 767 square meters (hereinafter “Defendant’s land”).

However, K, L, Defendant M, C, and D filed a lawsuit against Defendant E against Jeonju District Court 2005Kadan20356 against the Defendant for the implementation of the cancellation registration procedure on the ground that the registration of ownership transfer completed on the Defendant’s land is null and void.

Defendant E did not submit a written reply even after the receipt of the complaint, and on October 14, 2005, the Jeonju District Court sentenced Defendant E to comply with the procedure for registration cancellation of ownership transfer registration without holding any pleadings.

(The above judgment became final and conclusive around that time).

On the land on the part of the defendant's side, cement block structure roof 83.05 square meters (hereinafter referred to as "the defendant's side building") are located.

However, on February 3, 1986, Defendant E entered the building ledger as the owner of the building on the part of the Defendant, and completed registration of preservation of ownership by Jeonju District Court No. 55361, Jun. 4, 1999.

In the case of the Plaintiff’s land on the part of 1, 2, 3, 4, 5, 12, 11, 10, 9, and 11 in sequence of the indication of the annexed drawings among the land on the part of the Defendant’s side (hereinafter “the land in dispute of this case”), the foregoing part of 25 square meters (hereinafter “the land in dispute of this case”) shall be indicated by the block tank warehouse and boundary.
