A defendant shall be punished by imprisonment for not less than eight months and by a fine not exceeding three hundred thousand won.

Punishment of the crime

1. 모욕 피고인은 2015. 1. 7. 22:03경 제주시 C에 있는 D지구대 앞에서 음주운전을 하는 차량이 있다는 신고를 받고 출동한 제주동부경찰서 E지구대 소속 경장인 피해자 F으로부터 하차를 요구받자 그곳을 지나는 시민 등이 있는 가운데 피해자에게 “개 새끼야, 야 씨발 놈아, 좃밥 새끼들, 병신새끼 지랄하네”라고 큰소리로 말하여 공연히 피해자를 모욕하였다.

술 냄새가 나고, 얼굴에 홍조를 띠며, 발음을 제대로 하지 못하는 등 술에 취한 상태에서 운전하였다고 인정할 만한 상당한 이유가 있어, 위 G으로부터 같은 날 22:20경구 E지구대 앞 도로에서, 22:30분 및 22:40경 각각 E지구대에서 음주측정기에 호흡을 불어넣는 방법으로 음주측정에 응할 것을 요구받았음에도 입김을 불어넣는 시늉만 하는 방법으로 이를 회피하여 정당한 사유 없이 경찰공무원의 음주측정요구에 응하지 아니하였다.
